Terms of use
TillyFlo writes down what you tell it. It is not your accountant.
You are responsible for your own numbers, your own backups and your own tax.
Section 1Who you're dealing with
TillyFlo ("the app") is independently built and published from Ontario, Canada by its developer ("we", "us"). You can reach us at [email protected], and we will give our full registered details to anyone who asks for them. These terms cover both this website and the app.
By downloading, installing or using TillyFlo, or by using this website, you agree to these terms. If you don't agree to them, don't use it.
Section 2What TillyFlo is, and what it is not
TillyFlo is a record-keeping tool. It stores what you type into it and does arithmetic on it. That is the whole job.
If a number in TillyFlo matters to a decision with money or a tax authority attached to it, check it. We make the arithmetic as careful as we know how to, and we still won't stand behind a decision you made because of a figure on a screen.
Section 3Your licence to use the app
We grant you a personal, non-transferable, non-exclusive licence to use TillyFlo on any device that you own or control, as permitted by the usage rules of the app store you got it from, including any Family Sharing or volume purchase arrangements those rules allow. You may not rent, lease, lend, sell, redistribute or sublicense the app, or reverse-engineer, decompile or disassemble it except where the law says you may regardless of this term.
This licence covers the app as it exists. It is not a promise that any particular feature will exist forever, though we will not remove something you paid for without saying so.
Section 4Your data, and the fact that we don't have it
Everything you enter into TillyFlo is stored on your own device. We operate no server for it, hold no copy of it, and cannot see it. What that means in practice is set out in the privacy policy, and the important consequence is here:
You own the data you enter. You may export it at any time, and export will not be placed behind a payment.
Section 5Buying, refunds, and what "pay once" would mean
Any purchase you make is a transaction between you and Apple or Google, not with us. They take the payment, they issue the receipt, and refunds are handled under their policies, not ours. We never see your card details, your billing address or your name.
Where a part of TillyFlo is sold as a one-time purchase, "one-time" means the life of the app, not the life of the buyer: it covers this app and its updates, with no recurring charge, and it is not a promise that the app will exist forever or that every future product we make is included. Pricing for the paid features has not been finalised at the time of writing; whatever is published on this site at the moment you buy is what applies to you.
Prices can change for new buyers. A change never reaches back and charges someone who already paid.
Section 6No warranty
TillyFlo is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of defects, or that it will meet your requirements.
Some jurisdictions do not allow the exclusion of implied warranties, and in Ontario the Consumer Protection Act gives consumers rights that cannot be signed away. Nothing in these terms limits any right you have that the law says you keep. Where an exclusion is not permitted, it applies only to the extent it is.
Section 7Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill or lost or corrupted data, arising out of or connected with your use of TillyFlo, whether or not we were told such damages were possible.
Our total liability to you, for any and all claims, is limited to the amount you actually paid us for the app in the twelve months before the claim arose. If you use the free version, that is nothing. Again: where the law does not permit a limitation, it does not apply.
Section 8Using it properly
- Don't use TillyFlo to record or facilitate anything illegal.
- If you enter another person's details (a customer, a supplier, someone who owes you money), that information is yours to hold lawfully. We are not a processor of it, because it never reaches us. Complying with any privacy law that applies to you as the person holding it is your responsibility.
- Don't attempt to break, circumvent or resell the paid features.
- Don't use the TillyFlo name, wordmark or bird mark as if the app were yours, or in a way that suggests we endorse you.
Section 9Support
Support is provided by us and by nobody else. In particular, not by Apple, which has no obligation to furnish any maintenance or support for TillyFlo. Email [email protected] and a person will read it. We are one person and not a call centre; expect a real answer rather than a fast one.
Section 10Claims about the app
We, not Apple, are responsible for addressing any claim you or a third party makes about TillyFlo or your use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. We, not Apple, are also solely responsible for investigating and defending any claim that TillyFlo infringes someone's intellectual property rights.
Section 11Where the law applies
You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with any third-party terms that apply when you use the app, for example your mobile carrier's terms.
Apple Inc. and its subsidiaries are third-party beneficiaries of these terms where they govern your licence to use the app, and on your acceptance Apple has the right to enforce them against you as a third-party beneficiary.
Section 12This website, and emails
This website is informational. Things described here as planned or coming may change or not happen.
If you join the beta list you are giving express consent to receive email from us about TillyFlo: when the beta opens, and when the app ships. Every email we send identifies us and carries a one-click unsubscribe, and if you unsubscribe we will stop within ten business days, as Canada's anti-spam legislation requires. We do not sell, rent or share the list, and we do not send anything else to it.
Section 13Changes
We may update these terms. If a change is significant we will say so on this page and change the date at the top. Continuing to use TillyFlo after that means you accept the updated terms. If you don't, stop using it, and export your data on the way out.
Section 14Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it, and the courts of Ontario have jurisdiction, without depriving you of the protection of any mandatory consumer law of the country you live in.
